Terms of Use

1. Eligibility and accounts

You must be at least 18 years old to use the App. You sign in with your Apple ID or Google account and are responsible for all activity on your account. Provide accurate information and keep your account secure.

2. User-generated content

OpenMarina lets users post text, photos, reviews, comments, voyages, events and sea reports. You keep ownership of your content. By posting it, you grant OpenMarina a non-exclusive, worldwide, royalty-free license to host, display and distribute it within the App for the purpose of operating the service.

You agree not to post content that:

• is illegal, harmful, threatening, abusive, harassing, defamatory or invasive of privacy;
• contains sexually explicit material;
• promotes violence, discrimination or hate speech;
• infringes intellectual property rights;
• contains spam, malware or deceptive content;
• impersonates any person or entity;
• contains the personal information of others without their consent;
• is a deliberately false or misleading sea report.

OpenMarina has zero tolerance for objectionable content and abusive users. We may remove any content and suspend or terminate accounts that violate these Terms, without prior notice.

3. Content moderation

The App filters objectionable content, and users can report content and block abusive users. We review reports within 24 hours and take appropriate action, including removing content and removing users who violate these Terms.

4. Subscriptions

OpenMarina offers optional auto-renewable subscriptions ("Premium"), billed monthly or yearly. Payment is charged to your Apple ID account when you confirm the purchase. A subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the end of the period. You can manage and cancel subscriptions in your Apple ID account settings. Prices are shown in the App before you buy. Refunds are handled by Apple according to its policies.

5. Location data

The App uses your location to show nearby marinas, calculate routes, warn you about nearby sea reports and enable live tracking. Location sharing is optional and active only when you turn it on. Our Privacy Policy explains how location data is handled.

6. Navigation safety

OpenMarina is not a navigation instrument and must not be used as the primary means of navigation. Routes, distances, ETAs, AIS vessel positions, weather data, marina information and sea reports are provided for information and planning only. They may be incomplete, delayed or inaccurate. Always use official nautical charts and approved equipment, follow the international regulations for preventing collisions at sea (COLREGs), keep a proper lookout and use good seamanship. You are solely responsible for the safety of your vessel and crew.

7. AIS and third-party data

Vessel positions come from publicly available AIS data, marina data from OpenStreetMap and weather data from third-party providers. We do not guarantee the availability, completeness or accuracy of this data.

8. Acceptable use

Do not misuse the App: do not attempt to access other accounts, interfere with the service, scrape data, reverse engineer the App, or use it to stalk, harass or harm anyone.

9. Disclaimer

The App is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law. OpenMarina is not responsible for the accuracy of marina information, vessel positions, routes, weather or user-generated content.

10. Limitation of liability

To the extent permitted by law, OpenMarina is not liable for any indirect, incidental, special or consequential damages, or for any loss or damage arising from navigation decisions, from the use of the App or from the inability to use it.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms. You may stop using the App and delete your account at any time in the App settings.

12. Apple

These Terms are between you and OpenMarina, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and change the "Last updated" date. Continued use of the App after changes means you accept the updated Terms.
