1. Who we are

OpenMarina is developed and operated by Seçkin Sefa Durası ("OpenMarina", "we", "us"), who is the data controller for the personal data described in this policy. You can contact us at any time at [email protected].

2. Information we collect

• Account information: your name, email address and account identifier provided by Sign in with Apple or Google Sign-In. If you use Apple's "Hide My Email", we receive only the relay address.
• Profile and boats: username, bio, profile photo and the details of the boats you add.
• Content you create: posts, photos, comments, likes, marina ratings and reviews, voyages, events, sea reports and confirmations, follows and stars.
• Messages: the direct messages you send and receive, stored so that they can be delivered.
• Location data: your current position while live location sharing is turned on (including in the background while sharing is active), and the track of a voyage when you record one.
• Purchases: the status of your Premium subscription, which we receive from Apple. We never receive your payment card details.
• Device and technical data: device type, operating system version, push notification token, IP address, the time of requests and which features of the service are used. We keep these records for security, abuse prevention and legal compliance.
• Communications: the emails you send to our support address.

3. How we use your information

We use your information to:

• create and run your account and provide the features of OpenMarina (to perform our contract with you);
• show your profile, boats and content to other users, and your live position while you choose to share it (based on your choice and consent);
• calculate routes, show sea reports near you and send notifications about messages, follows, voyages and nearby hazards;
• process Premium subscriptions;
• keep the service safe: moderate content, handle reports, prevent spam and abuse, and protect our users (our legitimate interest);
• send you service emails and, unless you unsubscribe, occasional news about OpenMarina;
• comply with legal obligations.

4. Location data

Live location sharing is entirely optional and can be turned off at any time in the app. While it is on, other users can see your position on the map. Your live position is removed automatically 30 minutes after your last update. Location history is kept for up to 90 days and then deleted automatically. Voyage tracks and sailing statistics that you save remain in your account until you delete them or your account.

5. What other users can see

Your profile, boats, posts, comments, ratings, open voyages, events and sea reports are visible to other OpenMarina users. Your live position is visible only while you share it. Direct messages are visible only to the people in the conversation. You can block users, and blocked users cannot contact you.

6. Sharing with service providers

We do not sell or rent your personal data. We share it only with providers that help us run the service, and only as needed:

• Hetzner Online – servers and databases located in the European Union;
• Cloudflare – network security, content delivery and photo storage;
• Apple – Sign in with Apple, push notifications and in-app purchases;
• Google – Google Sign-In;
• Resend – delivery of the emails we send to you.

We also use public data sources that receive no personal data from you: OpenStreetMap for marina data, Open-Meteo for weather (we request weather for map coordinates only) and aisstream.io for public AIS vessel positions.

We may disclose personal data when required by law, for example in response to a valid request from a court or public authority, or when necessary to protect the safety of our users or others.

7. International transfers

Our main servers are in the European Union. Some providers listed above may process data in other countries, including the United States. Where this happens, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses.

8. How long we keep data

We keep your data for as long as your account is active, except where shorter periods are stated in this policy. When you delete your account, your account and your data are permanently removed from our active systems. Some records may remain for a limited time in backups or where we must keep them to meet legal obligations or resolve disputes.

9. Your rights

Depending on where you live, including under the EU General Data Protection Regulation (GDPR) and the Turkish Personal Data Protection Law (KVKK), you have the right to:

• access the personal data we hold about you and receive a copy;
• correct inaccurate data;
• delete your data — you can delete your account at any time in the app settings;
• object to or restrict certain processing;
• receive your data in a portable format;
• withdraw consent at any time, for example by turning off location sharing;
• lodge a complaint with your local data protection authority.

10. Emails

We send service emails about your account when needed. Marketing emails are sent only to users who have not unsubscribed, and every marketing email contains an unsubscribe link.

11. Age requirement

OpenMarina is intended for users aged 18 and over. We do not knowingly collect personal data from anyone under 18. If you believe a minor has created an account, please contact us and we will remove it.

12. Security

We protect your data with encrypted connections (HTTPS), access controls and restricted server access. No system is completely secure, but we work to protect your information and to respond quickly to any incident.

13. This website

This website does not use advertising or tracking cookies. It may store a single small cookie to remember that you have seen or chosen a language. Our hosting and security providers process technical data such as your IP address to deliver and protect the site.

14. Changes to this policy

We may update this Privacy Policy from time to time. We will post the new version on this page and change the "Last updated" date. For significant changes we will also inform you in the app or by email.
